Dispute resolution procedure


Resolutions of disputes in terms of the Act


Stage one Conciliation


Private Agreement


Parties can make provision for their own procedures for the settlement of disputes. Then they need not follow the Act.


“CCMA” if no council


Council


If dispute is unresolved


Stage two


The Act sets out which route a particular dispute must go at stage two. Parties may only depart from these routes by agreement.

The CCMA role is resolving disputes


The Commission for Conciliation, Mediation and Arbitration (CCMA) is a dispute resolution body established in terms of the Labour Relations. It is a government body and is not controlled by any political party, trade union or business. The aim of the CCMA is to restoring sound labour and industrial relations within the South African. It is a fast and very accessible way for employers and employees to resolve their labour disputes. Once all parties have agreed to a CCMA settlement, it becomes legally binding.
